By accessing or using the services provided by Kenki ("Service"), operated at kenki.ai ("we," "us," "our"), you ("User," "you") agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you must not use the Service.

We will provide you with notice of any material changes via email or through the Service at least thirty (30) days before such changes take effect. The Service offers both free and premium subscription tiers. By enrolling in a paid subscription plan, you agree to the following:

The Service, including without limitation its design, source code, features, trademarks, logos, and all related content (excluding user-submitted data), is the exclusive property of Kenki and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, license, or create derivative works based upon any part of the Service without our prior written consent.
You may close your account at any time through your account settings or by sending a written request to [email protected]. Upon account closure, your data will be deleted in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account if you:
Except where immediate action is necessary to protect the security or integrity of the Service, we will provide you with reasonable advance notice prior to any termination. You will be afforded a reasonable opportunity to export your data before termination takes effect.
To the maximum extent permitted by applicable law:
You agree to indemnify, defend, and hold harmless Kenki, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Prior to initiating any formal legal proceeding, you agree to contact us at [email protected] and to attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.
In the event that informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. Unless both parties agree otherwise, the arbitration shall be conducted remotely by videoconference or telephone.
You agree that any dispute resolution proceedings will be conducted solely on an individual basis. You hereby waive any right to participate in any class action, class-wide arbitration, or consolidated proceeding.
Notwithstanding the foregoing, either party may bring a qualifying claim in the small claims court of the county in which you reside.
You may opt out of the binding arbitration provision by delivering written notice to [email protected] within thirty (30) days of your initial acceptance of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law principles.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy, Medical Consent & Disclaimer, and Refund Policy, constitute the entire agreement between you and Kenki with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, or representations.
